We do not allow Warez, illegal MP3 Sites, IRC Bots, Adult only or Pirated Software Sites. All site content must be legal.
You may not store more data in your account than your alotted server space.
Your server space and ftp account is for your personal use only. You must not divulge the password to any
Backups
Proimpulse performs regular backups of data on our servers, however it is recommended that you keep an independent backup of all data stored on your web space. Proimpulse is not responsible for loss of data.
If you need a backup that we have restored then you may incur a charge of $20 minimum.
Server Abuse / Rules
You may not run server processes (eg. talkers/IRC Bots) from your web space.
We shall not be held liable for any loss or damages caused by the use or misuse, unavailability or removal of services.
When your account is closed, all files (including web pages, files etc.) will be deleted.
We reserve the right to cancel your account at any time without notice.
We reserve the right to amend and update these Terms and Conditions at any time without notice.
Although we advertise 99.9% uptime we do upgrade and modify servers which may cause downtime. We will also not be held responsible for any unforeseen events that cause downtime.
If any customer is rude, disrespectful to staff, users of Proimpulse we reserve the right to cancel services at any time without refund. We have the right to work without abuse, please respect this right.
Data Protection
To protect your privacy we never distribute your name or e-mail address to any third parties.
Users must not participate in any form of un-solicited bulk e-mailing or spam. By logging into your account, or uploading files to it, you are indicating your acceptance of these Terms and Conditions.
Bandwidth
Proimpulse operates a policy where in each hosting package, as a client you have limited bandwidth.
However, should your bandwidth reach the point where it has gone over your specified limit then we reserve the right to disable your site without prior notice. When you bandwidth limit is hit shared and reseller accounts will automatically show an account suspension page .
Web Pages
Commercial use of web and ftp space is permitted. Adult websites are NOT permitted to be hosted on our servers period!
You will be responsible for the content of your pages, including obtaining the legal permission for any works they include and ensuring that the contents of these pages do not violate US law.
You will be held responsible for and accept responsibility for any defamatory, confidential, secret or other proprietary material available via your page(s).
We reserve the right to remove material deemed inappropriate from your web pages, without prior notice.

Cancellation and Refunds
Monthly Hosting
Refunds are offered depending on circumstances of the request. We reserve the right not to refund clients.
We reserve the right not to issue refund if the client has signed up for fraud purposes.
Proimpulse reserves the right to cancel the service at any time. Customer refund will not occur if our service shuts down. We will then not host your website.
Account Suspension
Illegal Content
If you account has any illegal content we will contact you about this and request its removal. After 24 hours if you do not cooperate we will suspend your account. We reserve the right to suspend / cancel your servers at any time.
Billing
When you are billed for your hosting, you will receive reminders letting you know payment is due. If you do not pay your account is suspended. Payment must be made before the date on the invoice. If payment has not been made three days after this date your account is then suspended. If you still do not pay up to 10 days after the renewal date, your account will be removed from the server and all your data lost.
Fraud Sign Ups
We do not tolerate fraud signups at Proimpulse. Orders we think fit this category will be questioned. If the client then requests refund any charges that we incur for the refund will be charged to the client. We reserve the right not to refund fraud signups and may take legal action against such signups.
Hosting
We reserve the right to change any package at anytime, whether this is in regards to price or resources.
Indemnification
Customer agrees that it shall defend, indemnify, save and hold Proimpulse harmless from any and all demands, liabilities, losses, costs and claims, including reasonable solicitors fees asserted against
Proimpulse, its agents, its customers, officers and employees that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns.
Customer agrees to defend, indemnify and hold harmless Proimpulse against liabilities arising out of:
(1) any injury to person or property caused by any products sold or otherwise distributed in connection with
Proimpulse server.
(2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party.
(3) copyright infringement.
(4) any defective products sold to customer from Proimpulse server.
Disclaimer
Proimpulse will not be responsible for any damages your business may suffer, Proimpulse makes no warranties of any kind, expressed or implied for services we provide. Proimpulse disclaims any warrantor merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, viruses and any and all service interruptions caused by Proimpulse and its employees.
